PARTICIPANT AGREEMENT, RELEASE AND ACKNOWLEDGMENT OF RISK
In consideration of the services of Third Coast Outfitters of Texas LLC, its agent, owners, land owners, officers, employees and all other persons or entities acting in any capacity on its behalf, I hereby agree to release and discharge Lessor, Third Coast Outfitters, on behalf of myself, my heirs, personal representative and estate as follows:
1. I understand and acknowledge that the activity I am about to engage in bears known risks and unanticipated risks which could result in injury, death, illness, disease, emotional distress, or damage to myself, to property, or to third parties. The following describes some but not all of those risks:
The named below will be engaged in a hunting activity under the direction of Lessor, which necessarily involves the use of vehicles to transport us to and from the hunting areas, and dogs to retrieve game. I understand that each of these items may potentially pose a risk of serious bodily injury or death, and I further understand that there may be other such risks as well.
2. I expressly agree and promise to accept and assume all of the risks existing in this activity. My participation in this activity is purely voluntary; no one is forcing me to participate, and I elect to participate in spite of the risk.
3. I hereby voluntarily release, forever discharge, and agree to hold harmless and indemnify Lessor from any and all liability, claims, demands, actions or rights of action, which are related to and arise out of, or are in any way connected with my participation in this activity, including those allegedly attributable to the negligent acts or omissions of Lessor.
I specifically, by agreeing this document, have agreed to hold Lessor harmless from any act or omission of negligence for which Lessor may be responsible:
BY SIGNING THIS DOCUMENT, I ACKNOWLEDGE THAT IF ANYONE IS HURT OR PROPERTY DAMAGED DURING MY PARTICIPATION IN THIS ACTIVITY, I WILL HAVE NO RIGHT TO MAKE A CLAIM OR FILE A LAWSUIT AGAINST LESSOR, ITS AGENTS, OWNERS, LAND OWNERS, OFFICERS, EMPLOYEES, OR ANY OTHER PERSON OR ENTITY ACTING IN ANY CAPACITY ON ITS BEHALF EVEN IF THEY OR ANY OF THEM NEGLIGENTLY CAUSE SUCH INJURY OR DAMAGE.
4. Should Lessor, or anyone acting on its behalf, be required to incur attorney’s fees and costs to enforce this agreement, I agree to indemnify and reimburse them for such fees and costs.
5. I certify that I have health, accident and liability insurance to cover any bodily injury or property damage I may cause or suffer while participating in the event, or else I agree to bear the costs of such injury or damage myself.
My email submission below indicates that I have had sufficient opportunity to read this entire document,
that I have read it, and that I understand that it affects my legal rights; I agree to be bound by terms. If not, I will choose "no" and will not go hunting with the Lessor.
